Proposed Law:
This law amends Section 90 of Chapter 23 and Section 41 of Chapter 7 to require the approval of the Governor' Council for Gubernatorial appointments to the Commonwealth's Labor Relation and Civil Service Commission.

Rationale:
Both Civil Service Commissioners and Labor Relation Commissioners play a vital adjudicatory role in the Commonwealth Labor Management Process. The Governors Council, which has jurisdiction of other judicial and quasi-judicial gubernatorial appointments, would be an appropriate place to review appointments to these positions.

The Massachusetts AFL-CIO believes the Governor's Council would be an appropriate venue to revue these important positions to ensure that the appointment will fairly represent both sides of the issue that will be placed before them.

AN ACT TO ENSURE QUALITY APPOINTMENTS
Section 9O of Chapter 23 of the General Laws is amended by adding a new sentence to the end of subparagraph (c), "Effective January 1, 2004 any appointment of any member of the Labor Relations Commission will be by and with the advice and consent of the executive council."

SECTION 2. Section 4I of Chapter 7 of the General Laws is amended by adding a new sentence after the second sentence, "Effective January 1, 2004 any and all appointments and reappointments to the Civil Service Commission shall be made by the governor by and with the advice and consent of the executive council."
